Distance Sales Contract

This Distance Sales Contract (“Contract”) has been prepared in accordance with the Consumer Protection Law No. 6502 and the Distance Sales Regulation published in the Official Gazette of Turkey.

By placing an order through our website, the Buyer agrees to the terms of this Contract.

Buyer:
The individual who places an order on our website.
Contact details provided during checkout form part of this Contract.

2. Subject of the Contract

The subject of this Contract is the sale and delivery of products ordered electronically from the Seller’s website, in accordance with the relevant laws and regulations.

3. Product Information

Product type, model, quantity, price, and delivery information are shown on the checkout page and order confirmation email.
These details form an essential part of this Contract.

4. Delivery Terms

Products will be delivered to the address specified by the Buyer.
Same-day delivery is available for orders placed before 15:00, within Istanbul, depending on distance and courier availability.
Delivery time is estimated between 2–6 hours.
Free delivery applies within 35 km of Şişli; for longer distances, the Buyer must contact us.
If the Buyer or recipient is not available at the delivery address, the Seller will attempt to contact the Buyer for further instructions.

The Seller is not responsible for delays caused by incorrect address details or the unavailability of the recipient.

5. Right of Withdrawal

Under Article 15 of the Distance Sales Regulation, the right of withdrawal does not apply to:

Fresh flowers
Personalized products
Custom-made gift arrangements
Products that are prepared according to the Buyer’s personal requests (notes, names, colors, custom designs)

Therefore, these items cannot be returned or refunded unless specified under Section 6.

6. Return & Refund Conditions

Returns are only accepted if:

The product arrives damaged,
The wrong product is delivered,
The product does not match the description.

To request a return or refund:

The Buyer must contact the Seller within 2 hours of delivery.
Clear photo or video evidence is required.
Refunds will be issued after verification.

7. Order Cancellation

Buyer may cancel the order within 1 hour of purchase.
Same-day delivery orders cannot be canceled after the courier has been dispatched.
If materials have already been prepared, the Seller may deduct preparation costs.

8. Payment Terms

All payments are processed through iyzico or other approved payment providers.
The Buyer’s payment information is protected with SSL technology.
The Seller does not store or access credit card information.

9. Seller’s Responsibilities

The Seller agrees to:

Deliver products as described,
Communicate with the Buyer in case of delays or issues,
Follow all legal regulations regarding consumer rights,
Resolve disputes fairly and promptly.

10. Buyer’s Responsibilities

The Buyer agrees to:

Provide accurate address and contact information,
Be available or ensure the recipient is available during delivery,
Inspect the product upon delivery,
Notify the Seller promptly if there is an issue.

11. Force Majeure

The Seller is not responsible for delays or non-performance due to events such as natural disasters, extreme weather, strikes, riots, transportation disruptions, or other events beyond the Seller’s control.

12. Dispute Resolution

In case of disputes:

The Buyer may apply to the Consumer Arbitration Committee or
Consumer Courts in their district.

Legal limits for application are based on annual limits published by the Ministry of Trade.

13. Acceptance of Contract

By placing an order on our website, the Buyer confirms that they have read, understood, and accepted this Distance Sales Contract.
